Parallel import: Federal Arbitrazh Court of the North-Western District of Russia confirms decision in favor of Longines

In a decision rendered on July 18, 2012 the Russian Federal Arbitrazh Court of the North-Western District confirmed the decision taken by the Arbitrazh Court of Saint Petersburg and Leningrad region prohibiting the Russian companies LLC BESTWATCH.RU and the domain owner LLC ADELIYA to sell Longines watches which were imported into the territory of the Russian Federation without the consent of the trademark owner Longines Watch Co. Francillon Ltd. over their website. The court confirmed the principle of national exhaustion of the trademark rights and ordered these companies to pay a significant compensation for the infringement of Longines’ trademark rights. A recent application of LLC BESTWATCH.RU to the Supreme Arbitrazh Court to suspend the execution of the judgment has been denied.

Параллельный импорт: Федеральный арбитражный суд Северо-Западного округа оставил в силе решение суда, вынесенное в пользу компании Longines

Постановлением от 18 июля 2012 года Федеральный арбитражный суд Северо-Западного округа оставил в силе решение Арбитражного суда города Санкт-Петербурга и Ленинградской области, запрещающее российским компаниям ООО «Бэствотч.ру» и ООО «Аделия» (владелец домена) продавать на своем Интернет-сайте часы марки Longines, ввоз которых на территорию России был осуществлен без согласия владельца товарного знака – компании Longines Watch Co., Francillon Ltd. Суд подтвердил действие принципа национального исчерпания прав на товарный знак и взыскал с указанных компаний значительную компенсацию за нарушение прав на товарный знак Longines. Недавнее ходатайство ООО «Бэствотч.ру» о приостановлении исполнения судебного решения, поданное в Высший Арбитражный Суд РФ, было отклонено.
